Please read these Terms and Conditions (“Terms”) carefully before using the services offered by Epictetus Photography.

1. Acceptance of Terms

By accessing our website, booking our services, or using any of our photography services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our website or use our services.

2. Photography Services

2.1 Booking Process

• All bookings must be confirmed with a signed contract and deposit payment
• Dates are reserved only upon receipt of both signed contract and deposit

2.2 Rescheduling and Cancellations

• Initial booking charge of 100 rupees is refundable if service is cancelled.
• Rescheduling requests are subject to availability and may incur additional fees

2.3 Photography Coverage

• We will use professional judgment and reasonable efforts to capture all important aspects of your event
• We cannot guarantee specific shots or styles beyond our ability
• We reserve the right to use professional judgment regarding locations, poses, and photography techniques

2.4 Image Delivery

• Delivery timelines are estimates and may vary based on seasonal workload
• Album & Other Services will be delivered within 2 months of the event or as the client’s demand.
• Rush delivery is available for an additional fee
• All images undergo professional editing for color, exposure, and basic retouching

3. Payment Terms

• 30% Payment before event, 40% during event has to be paid. 30% payment has to be paid after the delivery of Album / Service
• Remaining balance due as per contract
• Late payments may result in cancellation of services
• Additional services requested after contract signing will be billed separately

4. Copyright and Reproduction

• EP Photography retains copyright of all images produced
• A personal use license is granted to clients for non-commercial purposes
• Commercial usage rights must be negotiated separately
• Images may not be altered, edited, or cropped when shared on social media
• Proper credit must be given when images are shared online

5. Model Release

• Clients grant permission to use images for marketing and portfolio purposes
• Clients wishing to restrict this usage must specify in writing before the event
• Additional fees may apply for exclusive usage rights

6. Limitation of Liability

• Our liability is limited to the total value of your contract
• We maintain backup equipment but cannot be held liable for technical failures or events which are beyond our control

7. Client Responsibilities

• Providing a shot list of essential photographs (if applicable)
• Securing necessary permissions for shooting locations
• Informing photographer of any restrictions at specific venues (if applicable)
• Designating a family member or friend to identify key people for group shots

8. Dispute Resolution

Any dispute arising from these Terms shall be resolved through:

• Good faith negotiation between parties
• Mediation in Kolkata, West Bengal
• Arbitration in accordance with Indian laws if mediation fails

9. Governing Law

These Terms shall be governed by the laws of India and the state of West Bengal at Baruipur Court.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised date.
